Employers of Australia have the flexibility to hire overseas workers under temporary skill shortage visa. It is a provisional visa plan that gives employees the opportunity to apply for a permanent visa. The temporary visa lets employers to sponsor a suitable skilled worker to fill a position that they cannot able to find in Australia. For some reasons, the visa appeal can be rejected from the side of sponsors. The article will address some important points why the TSS visa meets with rejection from sponsors’ side.

Not Satisfying LMT Report

Employers cannot sponsor overseas workers if they fail to meet the guidelines of LMT.  Labour Market Testing is a report that includes the detail of advertisements for the post in Australia for which employers are hiring overseas workers. LMT helps to avoid the chance of ignoring Australian workers by employers. The proof of LMT is advertisements given by employers to hire employees from Australia for the same position. There should be at least two advertisements. The advertisement must be in English and has published in the local print media or an authenticated job website. The advertisement includes all the details of the job such as title, job description, and salary.  Make sure your LMT requirements meet according to the guidelines.

Don’t Meet the Payment to Nominate Worker

As a sponsor, while nominating a worker, you will have to pay a certain amount. The cost depends on the stream you are applying under 482 visa.  For example, if you have applied to nominate workers under the short-term stream, you will have to pay a certain amount to nominate the worker and also need to pay the Skilling Australians Fund levy. Confirm the amount and pay accordingly.

Not Meeting the Market Salary

Your TSS visa can meet with rejection, if you are not meeting the standard salary. Standard business sponsors are required to offer employment terms and conditions to overseas workers that are comparable to those offered to Australian citizens or PR.  The Temporary Skilled Migration Income Threshold (TSMIT) plays an important role while determining the Market Salary for a TSS visa applicant.  It ensures that overseas workers are getting work as per the standard salary instead of hiring on cheap wages and working for longer hours.

The sponsor and the Australian authority sign a labour agreement. It is valid for 5 years. The duration can stretch for the next five years by reapplying the agreement.
